Nesta pesquisa, analisa-se como o Estado deve tratar os dados pessoais que lhe são confiados no exercício da função jurisdicional, considerando, principalmente, a ascensão da proteção de dados como direito autônomo e fundamental, bem como a plena vigência do respectivo marco regulatório, mas sem perder de vista os compromissos históricos do direito brasileiro com a ampla publicidade dos atos processuais. No contexto da investigação, destaca-se, dentre outras circunstâncias, o advento de um ambiente produtivo que tem a informação como mercadoria e cuja regulação, embora já tenha transformado atividades de empresas e órgãos governamentais, exerceu pouca influência, por ora, sobre a área macroprocessual finalística dos tribunais. Este trabalho não se dirige, portanto, às operações desenvolvidas por lawtechs e demais agentes econômicos em torno dos dados extraídos de demandas judiciais, mas ao fornecedor dessas informações, ou seja, o próprio Poder Judiciário, que, a propósito, sob as diretrizes do Conselho Nacional de Justiça (CNJ), passou por verdadeira revolução tecnológica nos últimos anos, na qual se incluem a digitalização dos acervos, a propagação de decisões na internet e a adoção da política de open justice. A partir da hipótese de que o conflito entre publicidade e proteção de dados pessoais pode ser dirimido à luz da Teoria dos Princípios, investiga-se, enfim, pelo método dedutivo, se – e como – as disposições gerais do marco regulatório da matéria (LGPD) podem neutralizar disfuncionalidades e contribuir com o aperfeiçoamento, em específico, do tratamento de dados pessoais em processos judiciais.

This research analyzes how the state should treat the personal data given to it in the exercise of its judicial function, taking into account, above all, the rise of data protection as an autonomous and fundamental right, and the full validity of the respective regulatory framework, but without losing sight of the historical commitments of Brazilian law to the broad publicity of procedural acts. In the context of the investigation, we highlight, among other circumstances, the advent of a productive environment that has information as a commodity, and whose regulation, although it has already transformed the activities of companies and government agencies, has had little influence, for now, on the macro-procedural area of the courts. This work therefore is not aimed at the operations carried out by lawtechs and other economic agents around the data extracted from lawsuits, but at the supplier of this information, i.e. the Judiciary itself, which, by the way, under the guidelines of the National Council of Justice (CNJ), has undergone a real technological revolution in recent years, including the digitization of procedural documents, the dissemination of decisions on the internet and the adoption of the open justice policy. Based on the hypothesis that the conflict between publicity and the protection of personal data can be resolved by the theory of principles, we finally investigate, using the deductive method, whether - and how - the general provisions of the regulatory framework on the matter (LGPD) can neutralize dysfunctionalities and contribute to the improvement, specifically, of the treatment of personal data in judicial processes.

deu: Diese Forschungsarbeit untersucht, wie der Staat persönliche Daten, die ihm im Rahmen seiner gerichtlichen Funktion übermittelt werden, behandeln sollte. Dabei wird vor allem der Aufstieg des Datenschutzes als eigenständiges und fundamentales Recht sowie die vollständige Gültigkeit des entsprechenden Regelwerks berücksichtigt, ohne jedoch die historischen Verpflichtungen des brasilianischen Rechts zur weitreichenden Publizität von Prozessakten außer Acht zu lassen. Im Rahmen dieser Untersuchung wird insbesondere auf die Entwicklung eines wirtschaftlichen Umfelds eingegangen, in dem Informationen als Handelsgut gelten. Trotz der tiefgreifenden Veränderungen, die Regulierungen bei Unternehmen und staatlichen Stellen bewirkt haben, ist ihr Einfluss auf die makroprozessualen Abläufe der Gerichte bislang noch begrenzt. Daher richtet diese Arbeit ihren Fokus nicht auf die Verarbeitung von Daten aus Rechtsstreitigkeiten durch Lawtechs und andere Marktteilnehmer, sondern direkt auf die Quelle dieser Informationen – das Justizsystem selbst. Unter den Richtlinien des Nationalen Justizrats (CNJ) hat die Justiz in den letzten Jahren eine signifikante technologische Umwandlung durchlaufen, welche die Digitalisierung von Prozessdokumenten, die Online-Veröffentlichung von Entscheidungen und die Einführung einer Politik der offenen Justiz umfasst. Basierend auf der Annahme, dass der Konflikt zwischen der Öffentlichkeit der Verfahren und dem Datenschutz durch die Theorie der Prinzipien gelöst werden kann, untersucht diese Arbeit abschließend durch eine deduktive Analyse, ob und wie die allgemeinen Bestimmungen des Regelwerks (LGPD) dysfunktionale Aspekte neutralisieren und speziell zur Verbesserung der Behandlung von personenbezogenen Daten in Gerichtsverfahren beitragen können.
